By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and nogoarohjx d.o.o., a company registered in Slovenia with registration number 3698521472.

If you are using our services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and your acceptance of these Terms will be treated as acceptance by that organisation.

nogoarohjx provides construction revenue performance analytics tools, project management insights, contractor intelligence services, and related software solutions designed for construction industry professionals. Our services include but are not limited to:

• Revenue tracking and financial performance analytics
• Project metrics and performance monitoring tools
• Contractor evaluation and intelligence platforms
• Custom analytics solutions and reporting services
• Data integration and business intelligence tools
• Professional support and consulting services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with appropriate notice to users.

User Obligations

As a user of our services, you agree to the following obligations and restrictions:

Unless otherwise agreed, payments are due in advance and are non-refundable. We reserve the right to suspend or terminate access to paid services for non-payment after appropriate notice.

All fees are exclusive of applicable taxes, duties, or similar charges, which you are responsible for paying. We may change our pricing with reasonable advance notice to existing customers.

Data and Privacy

The nogoarohjx platform, software, website, and all related content, features, and functionality are owned by nogoarohjx d.o.o. and are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to software code, algorithms, user interfaces, documentation, logos, and proprietary methodologies.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use our services for your internal business purposes. This licence does not include any right to resell or make commercial use of our services, collect or use product listings or descriptions, make derivative use of our services, or download or copy account information for the benefit of third parties.

You may not use our trademarks, logos, or branding without our prior written consent. Any feedback, suggestions, or improvements you provide regarding our services may be used by us without any obligation to you.

Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access to our platform. Our services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance when possible.

We do not warrant that our services will be error-free or that defects will be corrected immediately. However, we are committed to addressing technical issues promptly and maintaining the reliability of our platform.

Limitation of Liability

To the maximum extent permitted by applicable law, nogoarohjx d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to us for the services in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless nogoarohjx d.o.o., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Slovenia.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

Termination

You may terminate your account and stop using our services at any time by contacting us at legal@nogoarohjx.world. We may terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use our services will cease immediately. We may retain certain information as required by law or for legitimate business purposes. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

If your account is terminated for breach of these Terms, you may not be eligible for any refunds of prepaid fees.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes that materially affect your rights, we may provide additional notice through email or other communications.
